\u00ab Defending the age of law in the era of platforms: fighting illegal speech on the internet and protecting freedom of expression” by Gilles Le Chatelier and Denis Olivennes<\/h3>\n

The purpose of this note is to explore the possibility of an original status, halfway between the total irresponsibility of the host and the full responsibility of the publisher, which would make it possible to regulate the freedom of expression of contributors not according to the internal rules of the platforms but by virtue of the laws and under the control of the judge. It is not a question of creating new offences, nor is it a question of leaving platforms free to determine what is lawful and what is not, but of ensuring compliance with the laws that limit freedom of expression (insult, defamation, incitement to hatred, etc.)[\/vc_column_text][vc_button button_color=”accent” wide=”yes” border_width=”0″ link=”url:https%3A%2F%2Fwww.thedigitalnewdeal.org%2Fwp-content%2Fuploads%2FDND_PLATEFORMS_EN.pdf|target:_blank”]Download publication[\/vc_button][vc_column_text el_class=”textone”]The development of the Internet and social networks is constantly raising problems of freedom of expression. Every week there is a new controversy. One day, platforms are criticised for allowing hate speech, conspiracy theories and fake news to develop under the protection of anonymity, when they are not destabilising state operations. The next day, they are accused of censoring the President of the United States or some other contributor by virtue of opaque and unfair internal policies. The special nature of platforms, which are in some ways, by virtue of their weight and audience, the “essential facilities” of democracy, justifies thinking about how to regulate them with regard to freedom of expression.[\/vc_column_text][vc_row_inner row_inner_height_percent=”0″ back_color=”color-lxmt” overlay_alpha=”50″ gutter_size=”3″ shift_y=”0″ z_index=”0″][vc_column_inner column_width_percent=”100″ gutter_size=”3″ override_padding=”yes” column_padding=”3″ overlay_alpha=”50″ shift_x=”0″ shift_y=”0″ shift_y_down=”0″ z_index=”0″ medium_width=”0″ mobile_width=”0″ width=”1\/1″][vc_column_text el_class=”textone”]Gilles Le Chatelier<\/strong> est professeur associe\u0301 en droit public (Paris X Nanterre 2003-2005, Lyon II, 2005-2008, Ecole Normale supe\u0301rieure de Lyon 2008-2020), il pre\u0301side e\u0301galement le Conseil d\u2019administration de l\u2019IEP de Lyon depuis 2012. Il est e\u0301galement membre du conseil scientifique de l\u2019Actualite\u0301 Juridique des collectivite\u0301s territoriales (AJCT) et assure des publications re\u0301gulie\u0300res dans de nombreuses revues juridiques spe\u0301cialise\u0301es en droit public.<\/p>\n

Apre\u0300s un parcours d\u2019un peu plus de 20 ans au sein de l\u2019administration qui l\u2019a conduit a\u0300 occuper des responsabilite\u0301s importantes au sein de l\u2019Etat et des collectivite\u0301s locales (Conseiller d\u2019Etat, rapporteur adjoint au Conseil constitutionnel, expert aupre\u0300s de la Commission Europe\u0301enne,…), Gilles Le Chatelier est devenu avocat en mars 2011 et rejoint a\u0300 cette occasion le cabinet ADALTYS dont il a pris la pre\u0301sidence en janvier 2020.<\/p>\n

Denis Olivennes<\/strong>, ancien haut fonctionnaire, est chef d\u2019entreprise et auteur.
\nActuel coge\u0301rant du journal Libe\u0301ration. Il fut notamment directeur ge\u0301ne\u0301ral de Canal+, pre\u0301sident directeur ge\u0301ne\u0301ral de la Fnac, du Nouvel Observateur puis de Lagarde\u0300re Active (Europe 1, Paris Match, Elle, Journal du dimanche …).<\/p>\n

Auteur notamment de La gratuite\u0301, c\u2019est le vol : quand le piratage tue la culture (2007), Mortelle transparence avec Mathias Chichportich (2018) et Le de\u0301licieux malheur franc\u0327ais (2019).
